Damage Responsibility

12/09/15 – Recently an undetected slow leak on an upper floor resulted in considerable sheetrock damage to the unit below. Upon investigation, it was determined that the cause was a tub drain "awkwardly installed." Tub drains are outside owners' envelopes, so the leak belonged to the Vaux Owners' Association. CMI learned some interesting legal and insurance rules as a result of this incident.
When the cause of damage is property of a condo association, responsibility for repair devolves upon the owner of the damaged property. Odd, yes? But that's the law and insurance liability here in Oregon. Please note.
